Skilled Work Regional (Provisional) visa (subclass 491)

This is a visa for skilled nominated by a state or territory government to dwell and do jobs in regional Australia.

Basic Eligibility Criteria

  • Applicant needs to be invited to apply for this visa
  • Applicant must be nominated to apply by a state or territory government agency or must be sponsored by an eligible relative
  • Applicant must satisfy the points test
  • You need to have an occupation on the relevant skilled occupation list
  • You must have a suitable skills assessment for the occupation

Skilled Work Regional (Provisional) visa- Main Applicant

It is a provisional visa and is for skilled workers who want to reside and do jobs in regional Australia.

This visa permits you

  • Reside in Australia for 5 years from the date of grant of the visa
  • Dwell, do a job and entitled to enrol in a study course in a designated regional area of Australia
  • travel to and from Australia as many times as you want, while the visa is valid
  • If eligible, apply for permanent residence, through (Subclass 191) (Skilled Regional )Visa which commences on 16 November 2022.

Eligibility Criteria

  • Applicant needs to be invited to apply for this visa
  • Applicant must be nominated to apply by a state or territory government agency or must be sponsored by an eligible relative
  • Obligations: You and your family members must obey all Australian laws.
  • Applicant must satisfy the points test. You must be able to score 65 points or more.
  • You need to have an occupation on the relevant skilled occupation list
  • You must have a suitable skills assessment for the occupation: for that, you will need to provide a copy of this skills assessment with your application
  • Applicant must meet the Health and Character needs.
  • Family members, applying for the visa must qualify health and character requirements of the Australian Government.
  • Family members, even if not migrating to Australia, might also have to qualify for health and character requirements.
  • Australian Values Statement: – You must sign the Australian values statement, which assures that you will abide by all Australian laws and will respect their way of living.
  • Have paid Outstanding debt (if any) to the Australian Government: –If the applicant or any family member of the applicant owes any debt to the Australian Government, it must be paid back

Not be eligible: – In case of Previous Cancelled Visa.

Duration of Stay

  • This is a temporary visa.
  • Applicants can stay in Australia for 5 years from the date of grant of visa.
  • You can’t stay in Australia longer by extending this visa.

Family

  • Family members can be added to the application too
  • Family members can be included at the time of submission of your application
  • Family members, applying for the visa must qualify health and character requirements of the Australian Government.
  • If the applicant’s partner or dependent children are not included in this application, he/she needs to give the reason.
  • Family members, even if not migrating to Australia, might also have to qualify for health and character requirements.
  • The dependent child must be added after submission of the application but before a decision is made.

Cost

  • For the main Applicant, the visa cost is AUD4,045.
  • Additional charges are there for other family applicants applying.
  • Also, applications can’t be processed if correct visa application charges are not paid.
  • Family members having age 18 years or above need to pay Second Installment, those who:
  • Applies with the applicant for this visa.
  • Has less than Functional English.
  • The second instalment cost is AUD4,890.
  • Pay the second instalment only when asked to. It is charged only if a visa is going to be granted.
  • Other costs include are those of health checks, police certificates and biometrics.

Places to Apply From

  • You must be inside or outside Australia when you apply and during the decision of the visa, but not in immigration clearance.
  • If you apply in Australia, you must hold:
  • a substantive visa or
  • a Subclass 010 Bridging A visa,
  • a Subclass 020 Bridging B visa or
  • a Subclass 030 Bridging C visa,
  • otherwise, your application will not be valid.

Processing time

There are no standard processing times available for this pathway

Visa Label: – Your visa will be digitally linked to your passport so you won’t get a label in your passport.

Conditions for Skilled Work Regional (Provisional) visa- Main Applicant

  • 8515- Not marry or enter into a de facto relationship before entering into Australia, otherwise the applicant’s visa might get cancelled.
  • 8578-Need to notify if applicant’s passport or contact detail changes.
  • 8579-Dwell, study and work in a designated regional area.
  • 8580-Give evidence of applicant’s life, study or address of working place if requested.
  • 8581-Attend an interview if asked in a letter.
